Petal Wild – Terms and Conditions

1. Introduction
These Terms and Conditions (“Terms”) govern the rental of artificial floral arrangements (“Products”) by Petal Wild Ltd (“we,” “us,” or “our”) to you (“Customer” or “you”). By making a booking via our website, you agree to be bound by these Terms.
2. Booking and Payment
2.1 Booking Confirmation: A booking is confirmed upon receipt of a non-refundable deposit equal to 25% of the total rental fee.
2.2 Payment Schedule:
25% deposit upon booking.
50% due three months before the event date.
Remaining 25% due thirty days before the event date.
2.3 Payment Methods: Payments are accepted via BACS transfer or PayPal in GBP.
2.4 Late Payments: Late payments may incur interest at 4% per annum above the Bank of England base rate, accruing daily until payment is made.
3. Cancellations and Refunds
3.1 The deposit is non-refundable.
3.2 If the Client cancels the contract:
50% of the total fee will be retained if cancellation occurs within 30 days of the event.
100% of the total fee will be retained if cancellation occurs within 14 days of the event.
If the Florist cancels the contract due to unforeseen circumstances, a full refund of all payments (including the deposit) will be issued.
3.3 Force Majeure: In cases of events beyond our control (e.g., natural disasters, pandemics), we will endeavour to reschedule your booking without additional charges.
4. Delivery, Setup, and Collection
4.1 Delivery Area: We deliver within a 20-mile radius of Loughborough, England. Deliveries beyond this area may incur additional charges.
4.2 Setup and Collection: Standard rental includes one-time setup and collection at a single location. Additional setups or relocations will incur extra fees.
4.3 Venue Access: You must ensure that the venue allows sufficient access for delivery, setup, and collection. Any restrictions must be communicated to us in advance.
5. Product Care and Usage
5.1 Product Ownership: All rented Products remain the property of Petal Wild Ltd.
5.2 Usage Restrictions: Products are to be used solely for the agreed event and must not be altered, moved, or handled by anyone other than our staff without prior written consent.
5.3 Damage or Loss: You are responsible for any damage or loss of Products during the rental period. Charges for damage or loss will be up to four times the rental fee of the affected item.
5.4 We reserve the right to modify, relocate or remove any floral installation if weather conditions (including rain, wind or unsafe ground conditions) pose a risk to the flowers, equipment, venue or personal safety. The decision will be made at Petal Wild’s discretion and without any liability for any resulting aesthetic changes.
6. Liability
6.1 Limitation of Liability: Our liability is limited to the total amount paid for the rental. We are not liable for indirect or consequential losses.
6.2 Insurance: You are advised to obtain appropriate insurance coverage for the event, including coverage for rented items.
7. Privacy and Data Protection
We are committed to protecting your privacy. Personal data collected will be used solely for processing your booking and in accordance with our Privacy Policy, compliant with the Data Protection Act 2018 and the UK GDPR.
8. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
9. Amendments
We reserve the right to amend these Terms at any time. Any changes will be posted on our website and will take effect immediately upon posting.
